Law Firm Growth Consultant vs Marketing Agency: What Should Be Delivered?
A practical way to compare scope, accountability and handover when choosing a partner for the business behind the practice.
SwiftScale Editorial Updated
The short answer
A marketing agency may focus on demand and communications; a growth consultancy should examine how acquisition, intake, capacity and operations connect. Judge either provider by a defined scope, measurable deliverables, professional boundaries and a handover the firm can actually use—not by the label.
- Identify the binding constraint before buying more activity.
- Require deliverables with owners and acceptance evidence.
- Clarify data access, attribution, incentives and exit arrangements.
The distinction is scope, not superiority
Marketing expertise can be valuable when the firm needs positioning, campaigns or better communications. A broader consultancy is useful when the constraint spans multiple parts of the business—for example, more enquiries arrive but consultation capacity and follow-up remain inconsistent. Neither model is automatically right.
The provider’s title tells little about what will be delivered. Ask how the work changes the firm’s day-to-day operating system, what decisions remain with leadership and how outcomes will be measured. A good specialist should be willing to say when the firm needs something outside the specialist’s scope.
Diagnose the constraint across the whole journey
Trace suitable demand through enquiry handling, consultations, engagement, legal delivery, billing and collections. Record the owner and delay at each handoff. The constraint may be weak demand, poor fit, missed follow-up, limited lawyer capacity or slow financial processes. Buying more traffic without this diagnosis can worsen the problem.
Use a baseline and document its limitations. If sources are inconsistently recorded or historical engagement data is incomplete, fix those gaps before claiming precise attribution. Interviews with the team and a review of representative workflows can reveal information dashboards miss.
Ask for deliverables with acceptance criteria
“Improve growth” is too broad to verify. Require a small set of deliverables tied to the constraint: an intake stage map, recruiting scorecard, approved reporting definitions or operational handoff checklist. Each should have an owner, deadline and evidence of completion.
Acceptance should include actual use. A document sitting untouched in a shared folder is different from a trained team running the process. Define who approves the work and how defects are corrected.
| Deliverable | Evidence of acceptance | Firm owner |
|---|---|---|
| Baseline and constraint diagnosis | Sources, assumptions and agreed priority recorded | Leadership |
| Intake workflow | Synthetic test and supervised operational review | Intake lead and responsible lawyer |
| Hiring scorecard | Approved role boundaries and selection rubric | Hiring manager |
| Reporting definitions | Denominators and cohort timing documented | Operations or finance |
| Handover | Access, training and process ownership confirmed | Designated system owner |
Pilot before widening the engagement
Choose an intervention with a defined hypothesis, evaluation period and stopping rule. Limit the pilot to the part of the workflow leadership can supervise. A failed test should produce an explanation and a next decision, not a reason to expand the scope indefinitely.
SwiftScale’s stated commercial approach is performance before contractual engagement: KPIs are agreed and reached first, with ongoing retainers based on continued performance. The parties still need to document permitted work, approvals, access and the exact KPI definitions before any pilot activity begins. Performance positioning is not a substitute for clear governance.
Define attribution and commercial accountability
Agree what the provider controls and what depends on the firm. Advertising, intake coverage, appointment capacity and case acceptance are connected but owned by different people. A rate can change because of source quality or because the firm had no appointments available; the reporting should make that distinction visible.
Track operational adoption and stage outcomes first. Evaluate engagements, billed fees and collected revenue separately over the appropriate period. Avoid attributing every commercial improvement to the consultant when pricing, seasonality or matter mix also changed.

Review incentives, confidentiality and professional boundaries
Ask whether the provider has vendor affiliations or incentives relevant to recommendations. SwiftScale’s Clio partnership should be disclosed when comparing legal technology. Evaluate the recommendation against the firm’s requirements regardless of that relationship.
The lawyer must retain control over advice, conflicts, representation and professional judgment. Consultants generally do not need full client files to evaluate funnel performance. Compensation linked to referrals or legal fees requires jurisdiction-specific review; describing a arrangement as “performance-based” does not make it permissible.
Make the exit as clear as the start
The firm should retain usable access to accounts, process documents, approved creative and appropriate data exports. Confirm administrator permissions, integration ownership and access removal. A consultancy should leave the firm with a clearer system rather than unnecessary dependence.
An effective final review asks what changed, what evidence supports it, what remains uncertain and who owns the next action. That is the difference between a report celebrating activity and a handover leadership can operate.
Common questions
Does every law firm need a growth consultant?
No. A focused specialist may be enough for an isolated need. A broader consultancy is useful when the constraint spans acquisition, intake, people and operations.
What KPIs should be in a consultancy engagement?
Use the measures tied to the actual constraint, with defined denominators, cohorts and responsibilities. Examples include qualified-enquiry handling, consultation attendance or complete operational handoffs.
Is performance-based compensation always allowed?
No. The substance of referral payments, legal-fee participation and control rights must be reviewed under local professional-conduct rules.
